Bankruptcy
The Bankruptcy laws were established to allow people to get a fresh financial start. I represent creditors (individuals and commercial clients) in bankruptcy proceedings that are initiated to reorganize debts under a plan, or to have the debtor’s remaining assets distributed among the creditors thereby discharging the debtor from further obligation or restructuring. Each situation is different and I will work to explain your options to seek the best solution.

Filing bankruptcy can be a stressful decision and I will try to minimize your concerns by explaining the procedures in detail and preparing you for each phase of bankruptcy. Chapter 13 and 7 present two options for individuals who have found themselves unable to regularly deal with their creditors as they had once agreed. Chapter 7 is used to “wipe out”, or “erase” certain types of bills, like credit card debt, medical bills, and other secured debts. Unsecured debts are those bills where there was no collateral put up to secure the loan. We use Chapter 7-type bankruptcy to give folks a “fresh start” after wiping out their unsecured debts.

Chapter 13 is a debt repayment plan for those with a reliable source of income to continue making payments to their creditors at a reduced rate. Payments are made through the Court to your creditors. Bills such as mortgage, car note, or taxes can be consolidated into an affordable payment by filing Chapter 13.

Business Organizations
The selection of the form of business for a business entity affects every aspect of its operations. I will fully explain and assist in formation and business planning in deciding whether to operate as a closely held business, limited liability company, partnership, or corporation. I advise clients about director’s and officers’ liability, dissolution, reorganization, joint ventures, mergers, acquisitions, divestitures, business successions, and shareholders’ rights.

Estate Planning, Probate and Trust Administration
The process of transferring the assets of a decedent to heirs and beneficiaries in an effective and economic manner with the least tax impact can be complicated. I assist in pre-death planning for the distribution of assets at death, including preparation of wills and trusts. I also assist clients in business succession planning and asset protection planning.

Durable Powers of Attorney allow you to designate someone to take care of your banking, business and other activities that you may not be unable or unwilling to do. This often happens when you are too ill to make decisions.

A Living Will directs your family and doctors that under certain medical conditions you do not want to be kept alive artificially.

I represent plaintiffs or defendants if a dispute arises, such as Will contests, undue influence claims, lack of testamentary capacity issues, elective share options or other possible litigious situations.
